1. Acceptance of terms

By accessing, browsing, or using Nexus Vault (the "Service"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must stop using the Service immediately.

2. Eligibility

You must be at least 18 years old to use the Service, list items, or make purchases. By using the Service, you represent that you are 18 years of age or older and have the legal capacity to enter into binding agreements.

3. What the Service provides

Nexus Vault provides a platform for collectors to catalogue, value, display, and trade collectibles. Sellers list items at their own prices; buyers may purchase outright or submit offers. Postage and delivery are arranged separately between buyer and seller, and buyers are responsible for postage costs unless otherwise agreed.

4. Prohibited uses

You must not use the Service to:

  • sell, trade, or promote illegal goods, counterfeit items, or stolen property;
  • harass, threaten, defraud, or mislead other users;
  • upload, transmit, or distribute any material that is unlawful, obscene, defamatory, or that infringes the rights of any third party;
  • attempt to disrupt, damage, or gain unauthorised access to the Service or its systems;
  • use automated scripts, bots, or scrapers to access the Service without written permission.

We have a zero-tolerance policy for illegal content, including child sexual abuse material, threats of violence, or content that promotes self-harm. Violations may be reported to law enforcement and will result in immediate account termination.

5. Listings and transactions

Sellers are responsible for ensuring that listings are accurate, truthful, and that they have the right to sell the item. All items are sold in the condition displayed in their photographs and descriptions. Any concerns or questions must be raised before purchase.

Change-of-mind returns are not accepted. Refunds or remedies will only be provided where required by Australian law, including when an item is faulty or not as described.

6. Intellectual property

All content, branding, software, and designs on the Service are owned by or licensed to Nexus Systems. You may not reproduce, modify, or distribute any part of the Service without prior written permission, except as permitted by law or for your own listings.

7. Australian Consumer Law & statutory rights

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Competition and Consumer Act 2010 (Cth) or the Australian Consumer Law that cannot lawfully be excluded.

Where a non-excludable guarantee is breached and the breach is not a major failure, our liability is limited (at our option) to re-supplying the Service or paying the cost of having the Service re-supplied. Any conflicting provision in these Terms is read down to the minimum extent necessary.

8. Liability

To the fullest extent permitted by law, Nexus Systems is not liable for any indirect, consequential, incidental, or punitive loss or damage arising from your use of the Service or any transaction between users. This does not affect any non-excludable rights you may have under Australian Consumer Law.

9. Governing law and jurisdiction

These Terms are governed by the laws of Queensland and the Commonwealth of Australia. Any dispute arising from these Terms or the Service will be subject to the non-exclusive jurisdiction of the courts of Queensland and the Federal Courts of Australia.

10. Severability and entire agreement

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remainder will continue in effect. These Terms, together with the Privacy Policy, Refund Policy, and any other published policies, constitute the entire agreement between you and Nexus Systems regarding the Service.
